01

Eligibility and accounts

You must be at least 21 years old to create an account or use Common Hours. By using the service, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

You agree to provide accurate information and keep it reasonably current. You are responsible for activity through your account and for keeping access to your email secure. You may not impersonate another person or create an account for someone else without permission.

02

What Common Hours does

Common Hours provides tools for people to create, discover, organize, and join independently hosted dinner parties.

Common Hours is not the organizer, host, caterer, restaurant, landlord, transportation provider, security provider, payment processor, or operator of user-created dinners. Hosts are responsible for their dinners, and guests are responsible for deciding whether a particular dinner is appropriate for them.

03

Hosts and guests

Hosts must accept the Hosting Agreement before publishing a dinner. Guests must accept the Guest Agreement before requesting a seat. Both agreements are incorporated into these Terms.

Hosts may approve, decline, or remove guest requests at their discretion, subject to these Terms and applicable law. A request does not guarantee a seat, and an accepted request does not guarantee that a dinner will occur.

04

Dinner information and private details

Hosts are responsible for providing accurate information about a dinner, including its date, time, city, neighborhood, capacity, food information, and any requirements disclosed in the listing or guest questions.

Common Hours shows only the neighborhood and city publicly. The exact address and arrival instructions are made available to accepted guests beginning on the calendar day before the dinner in the dinner’s local time zone. Users may not publish another person’s home address or misuse private details obtained through Common Hours.

05

Food, allergies, and dietary needs

Food at a dinner may be prepared in a private home or another environment that is not a commercial kitchen. Common Hours does not inspect kitchens, prepare food, certify hosts, or guarantee food safety.

Hosts should accurately describe food and any accommodations they have agreed to make. Guests are responsible for communicating allergies, intolerances, and medical dietary restrictions directly to the host and deciding whether attending is safe. Common Hours does not guarantee that food will be free from allergens, cross-contact, contamination, or foodborne illness.

06

Give Back donations

Give Back lets hosts invite guests to bring food items for a selected local organization. Hosting a collection and contributing items are optional. A donation is not required to request a seat or be approved for a dinner.

Hosts may decline donated items, including items that are opened, expired, unsafe, or not accepted by the selected organization. Hosts must handle any items they accept safely and deliver them to the organization identified for that dinner, following that organization’s donation requirements and the Hosting Agreement. Accepted items may not be kept for personal use, sold, or redirected to another recipient.

The host coordinates collection and delivery. Listing an organization on Common Hours does not imply that it sponsors, endorses, or partners with Common Hours or the dinner.

07

Alcohol

If alcohol is present, hosts and guests must comply with applicable law. No person under the legal drinking age may be served or consume alcohol. Users may not unlawfully sell alcohol through or in connection with Common Hours.

Each person is responsible for their own consumption and transportation decisions and must not drive while impaired.

08

Ticket payments

Approved hosts can sell dinner tickets through their connected Stripe accounts. The host is the seller and is responsible for the dinner, payments, taxes, refunds, and disputes. Stripe processes the payment and pays the host. Common Hours provides the RSVP and payment-coordination tools and takes a 2% application fee on successful ticket sales.

Continuing with a paid RSVP authorizes the host to charge the displayed ticket price if approved, at the cancellation deadline shown on the RSVP or immediately if approved after that time. Guests can cancel before the displayed date and time at no cost for a full refund. Later cancellations do not automatically refund the ticket. Host cancellation or removal of a paid guest authorizes a full refund, including our application fee. The Guest Agreement and Hosting Agreement describe these payment rules.

Hosts must clearly disclose prices before an RSVP and manage their financial account with Stripe, subject to Stripe’s agreements and eligibility requirements. Hosts remain responsible for applicable taxes, permits, food-service rules, alcohol rules, and other legal obligations. Common Hours does not guarantee successful payments, payouts, or refunds. Surprise or misleading charges are prohibited. These terms do not limit rights that cannot be excluded by law.

09

User conduct

You may not use Common Hours to engage in harassment, threats, violence, stalking, sexual misconduct, fraud, theft, illegal drug activity, property damage, unlawful discrimination, or other illegal or dangerous behavior.

You may not scrape the service, interfere with its operation, bypass access controls, use another person’s private information for an unrelated purpose, or use Common Hours to send spam or conduct unauthorized commercial activity.

10

Your content and photographs

You retain ownership of photographs, descriptions, profile information, dinner information, and other material you submit. You grant Common Hours a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use that content to operate, improve, market, and promote Common Hours, including on Common Hours websites, social channels, and advertising.

You represent that you own or have permission to submit the content and grant this license, including permission from identifiable people where required. Attendance at a dinner by itself is not blanket consent to commercial use of someone’s likeness. Do not photograph, record, or publicly identify someone in a way they have asked you not to.

We may remove or restrict content that violates these Terms or creates safety, legal, privacy, or operational concerns.

11

Ratings

Accepted guests may be invited to give a star rating after a dinner. Ratings may contribute to an aggregate host rating after enough ratings have been received. Common Hours does not currently publish written reviews or verify whether an accepted guest actually attended.

You may not manipulate ratings, submit ratings through multiple accounts, or offer something of value in exchange for a particular rating.

12

Changes and cancellations

Hosts may update or cancel dinners, and guests may cancel requests or give up accepted seats. Users should make changes promptly and provide accurate information.

Common Hours is not responsible for food, travel, purchases, missed opportunities, or other expenses or losses caused by a changed or canceled dinner, a guest who does not attend, or a dinner that does not proceed as expected.

13

Safety

Meeting people you do not know and entering private residences involves inherent risk. Common Hours does not conduct comprehensive background checks and cannot guarantee a user’s identity, intentions, conduct, or safety.

Use reasonable judgment when hosting or attending. If there is an immediate threat to someone’s safety, contact emergency services.

14

Communications

Common Hours may send sign-in codes, request updates, host decisions, cancellations, reminders, rating invitations, hosting invitations, new-public-dinner notifications for hosts you subscribe to, and other communications related to the service. You can stop a host’s new-dinner emails by unsubscribing on that host’s dinner page. You are responsible for keeping your email address accurate and understanding that delivery is not guaranteed.

If you optionally provide a mobile phone number and actively select text reminders on a seat request, you agree to receive up to two transactional text messages from Common Hours about that dinner: one if the host accepts your request and one reminder on the day before the dinner. Message and data rates may apply. Consent to texts is optional and is not a condition of requesting a seat.

Reply STOP to opt out or HELP for help. You may also contact hello@commonhrs.com for support. Wireless carriers are not liable for delayed or undelivered messages. The handling of mobile information is described in our Privacy Policy.

15

Common Hours property

The Common Hours name, branding, design, software, and original content belong to Common Hours or its licensors. Except where law permits otherwise, you may not copy, sell, reverse engineer, or commercially exploit the service without permission.

16

Suspension and termination

We may remove a dinner, restrict hosting privileges, or suspend or terminate an account when we reasonably believe doing so is necessary to protect users, enforce these Terms, prevent abuse, or comply with law. You may stop using Common Hours at any time.

17

Disclaimers and limitation of liability

Common Hours is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Common Hours disclaims warranties concerning the service and user-hosted dinners, including their availability, reliability, quality, safety, legality, and suitability.

To the fullest extent permitted by law, Common Hours and its owners, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the service or a dinner. Nothing in these Terms excludes liability that cannot legally be excluded.

To the extent permitted by law, you agree to indemnify and hold Common Hours harmless from claims, losses, damages, and reasonable legal expenses arising from your content, a dinner you host, your conduct at a dinner, or your violation of these Terms.

18

Changes, governing law, and contact

We may update these Terms as Common Hours changes. We will update the date above and provide additional notice when reasonably appropriate or legally required. Continued use after updated Terms take effect means you accept them where permitted by law.

These Terms are governed by Texas law, without regard to conflict-of-law rules. Any dispute not otherwise resolved will be brought in a court of competent jurisdiction in Texas, unless applicable law requires otherwise.
